I know this is an old letter from the USA , but in my personal experience the UK is even worse when it comes to claims of Domestic Violence by the mother , the UK Police lap this up without even speaking to the other person and by default makes it fact ! The Lancaster Police department in the UK and Chester are prime example of Poor policing without fact or basis !

We, the undersigned, are writing in hopes of bringing to your attention a dire injustice that is occurring in our state as well as many others across the US. Laws enacted to protect the victims of the vile crime of domestic violence are being misused by both citizens as well as law enforcement, and in this process innocent men’s lives are being destroyed.

In most states, including Alaska, the burden of proof is being thrown out and the simple word of the accuser is being taken without question, many times without the accused even being allowed to speak.

True victims of domestic violence, some of whose names you will find below, find this to be deplorable.
Not only can someone falsely accuse another of domestic violence without fear of consequence, but the accused has no voice against the accuser. The accuser can be a mentally disturbed individual using such laws to exact her revenge against a man who simply does not want to be in a relationship anymore, and their word is automatically taken, even when no evidence is in place.

The accused in such cases is automatically arrested, injunctions are automatically set in place, and even if he is able to prove his innocence in court he has lost months of his life due to the fact that she cried wolf. Worse yet are the cases of these innocents who are poor and have no means to hire private attorneys. Their public defenders assume they are guilty and therefore do only the bare necessities to be their legal voice.

We are not in any way asking for a revocation of the laws that protect true victims of domestic violence. Our wish is that these laws be revisited and indications made to allow for criminal and civil prosecution when someone, whether male or female, has misused these laws in a vindictive and cunning way. We also would ask that law enforcement officers, public attorneys, and judges be forced to recognize the precept that the accused is innocent until proven guilty.

I have lived in Alaska my entire 41 years and have been a lifeguard, a volunteer firefighter and EMT, a member of the MSB Local Emergency Planning Committee and a local business owner. I love my community and I love my children, but I too have been falsely accused of Domestic Violence. I have seen my children only 3 days since before Christmas 2011.

I am forced to listen to my daughter call me on the phone leaving messages where she is crying for me to please call her back and let her know I am OK. I can hear my soon to be ex-wife in the background chit chatting with her new friend unconcerned about her daughter crying to know where her daddy is.

I suspect she know our daughter calls me and thinks the tears and crying of our daughter might provoke me into violating the restraining order and call her back. She could then have me thrown into jail and lose any chance of future custody. She may end up being right as with each call I feel my resolve slipping. She moved out of our marital home with all of the family money, leaving me penniless only to find the checks I signed over to her to pay the bills had not been used for that purpose and the utilities are now all subject to immediate disconnect.

She filed the DV charge because I discovered my son posted on Facebook thoughts of suicide and not being able to get in touch with her so we could speak to him drove to her house where she had custody of them for the week. I found her absent from the new home and at her boyfriend’s house in the middle of the night.

I couldn’t care less about that, but I learned the next morning, she had left my two 11 year old children alone in the night sleeping in their beds and no idea she had even left. To make it worse she had turned her phone off so if they had woke up they would have been unable to reach her. We were sharing custody at the time and I told her if she did it again I would call the police and take the children into my custody. She did it again two night later.

I brought the children home with me and decided I would not call the police on her. That was a mistake. I filed divorce the following Monday and after my wife was served the paperwork I was immediately served with a restraining order for domestic violence and I am now unable to even go near the new townhouse to ensure the behavior is not continuing.

This law is entirely out of control.

There needs to be penalties to these people who abuse the system for their own selfish gain. The law was enacted to protect innocent powerless victims not create new ones, which is what it is doing at a ratio of creating 4 new victims to every 1 it actually helps protect.

Before this happened to me I was clueless to the injustices of this law, nor did I realize just how common of a divorce tactic it has become.

I am aware now and I can tell you, this is something I will be watching with great interest to determine just which constituent will gain my vote from now. If I am not entirely alienated from my children during this whole proceeding and I have a chance to see and hug them again and hopefully raise them, I will teach them the importance of watching our legislature elected and the way they vote in the interests of those they serve to determine their own votes someday.

Respectfully,

Good afternoon little men!

Hope you both are doing very well on this lazy Sunday… Feels like a Sunday today…lol

I have been out to the mall for a bit this morning, took a little longer as what I thought it would as I was stuck in traffic right from the gates of my complex , never seen that before , after about 10 min we started moving and then I saw two monkeys have driven into to back of each other whiles coming out of the Church at the end of the road….. Always amazes me how people do that when they are driving at 5 miles an hour, guess they are not looking at the road…..

It’s really cool here today , I can almost say cold …. Ouma and Oupa decided its duvet and telly weather so have not seen them much today …..I myself put a jumper on this morning , don’t think you both know , but I am never cold as a rule, I don’t like wearing a jumper or a coat for that matter…..

I see the BBC twitter page is still full of updates re the floods in the UK , glad I am not there now as I am sure the park on the grounds at my flat in Horsham would have been well flooded by now… You guys would have loved that park as a play area, I did post pictures to your email accounts, just a pity you never got the opportunity to enjoy it or even see it……The kids bike routes were very cool, loads of open park space and fun hide and seek areas…. We would have been able to have so much fun playing around there…. Guess that was not meant to be……

You two must be getting ready for your Sunday Dinner shortly , hope you are having some nice crisp roast potatoes , they have always been my favourite part of a Sunday Dinner…..o and loads of gravy…… I am not so big on the whole vegetable idea but I do hope you both are eating all your veggies as I am told it will make you both big and strong….

Remind me one day to let you both try pumpkin the way we make it in South Africa as I know you don’t eat pumpkin in the UK and don’t find it easily in a shop , we make it with a little bit of sugar and nutmeg , yes I know that sounds strange but I promise you both it is yummy……

So tomorrow is the start of a new week again , I hope you both will have a great one full of fun and learning … I am not sure what times I will write you both as I am not sure what time I will be at the hotel , but I will write you both before I go to bed, I promise , will see if I can take some pictures of the country side , it should be lovely and green with all the rain we have had…..

As always Champs , I will see you both later tonight under our big old green tree in dream land , bringing you both big bear cuddles …….

Night , night little men…..happy dreams…….

Love you both around the world and back and miss you more …….

Love you boys…..

Dad xx

I find this article shocking , as I was a full time employed , very well paid Dad fighting to remain in the UK to see my boys but was held to ransom by the Government until the ” mother” agrees to contact !

Mark Harper resignation letter: In full
Immigration minister Mark Harper has written to the prime minister to resign from the government after it emerged his cleaner did not have permission to work in the UK. Here is his full letter, and David Cameron’s acceptance.

Dear Prime Minister

In April 2007 I took on a cleaner for my London flat. In doing so, I was very mindful of my legal and financial obligations and undertook a number of checks beforehand.

This included consideration of the HMRC tests as to whether the cleaner was performing her work under a contract for services on a self-employed basis which I concluded she was. However, even though there was no legal requirement for me to check her right to work in the UK, I felt that it was appropriate to do so.

I therefore took a copy of her passport to verify her identity and also a copy of a Home Office letter, dated 26 January 2006, which stated that she had leave to remain indefinitely in the United Kingdom, including the right to work and engage in a business.

I considered the issue again when you appointed me as a minister in the Cabinet Office in May 2010 and concluded that as I had performed a right to work check in 2007 and that my cleaner had indefinite leave to remain in the UK no further check was necessary.

I consider that as immigration minister, who is taking legislation through Parliament which will toughen up our immigration laws, I should hold myself to a higher standard than expected of others”

Mark Harper
When you then appointed me as immigration minister in September 2012 I went through a similar consideration process and once again concluded that no further check was necessary. In retrospect, I should have checked more thoroughly.

As I took the Immigration Bill through Parliament in autumn 2013 I talked a lot about these matters in the context both of employers and landlords.

What we do, and will, require of both is that they carry out reasonable checks and take copies of documents. We do not require them to be experts or spot anything other than an obvious forgery.

Given this focus on these matters, I thought it prudent to check that all my documents were in order for my cleaner. I undertook an extensive search to locate the copies of documents I had taken but unfortunately I was unable to locate them.

As a result, in the week commencing 20 January 2014 I asked my cleaner for further copies of these documents which she provided on 4 February. On 5 February, I asked my private office to check the details with immigration officials to confirm that all was in order.

I was informed on the morning of 6 February that my cleaner did not in fact have indefinite leave to remain in the United Kingdom. I immediately notified the home secretary and my permanent secretary. This is now a matter for immigration enforcement.

Although I complied with the law at all times, I consider that as immigration minister, who is taking legislation through Parliament which will toughen up our immigration laws, I should hold myself to a higher standard than expected of others.

I have also considered the impact on my Parliamentary colleagues, the government and you. I have always believed that politics is a team game, not an individual sport. Under the circumstances, I have therefore decided that the right course is for me to return to the backbenches. I am sorry for any embarrassment caused.

I am grateful for the opportunities you have given me since you became Leader of the Conservative Party, first in opposition and then in government. I will continue to support you as prime minister, the Conservative Party and this government in whatever way I can from the backbenches. I will also continue to serve my constituents in the Forest of Dean to the best of my ability.

Yours ever,

Mark

It is typical of you that you should be so mindful of the wider interests of the government and the party”

David Cameron
I am very sorry indeed to see you leave the government, but I understand your reasons for doing so.

In particular, I understand your view that, although you carried out checks on your cleaner, you feel that you should hold yourself to an especially high standard as immigration minister. You have taken an honourable decision.

You have been a highly effective minister in the government – both most recently as immigration minister, overseeing the passage of the Immigration Bill with great skill and dedication, and before that as a minister in the Cabinet Office. You can be very proud of what you have achieved in government – and before that in opposition.

I have always enormously appreciated your energy and your loyalty. It is typical of you that you should be so mindful of the wider interests of the government and the party in reaching the decision that you have, and I am very grateful for that.

You will be greatly missed, and I hope very much that you will be able to return to service on the frontbench before too long.

With all good wishes.

Yours,

David

Good afternoon little men!

Hope you both are doing really well today… It’s a lovely day here , nice and Sunny but cool….

Been up since 6am this morning not sure why as I had all good intentions to have a sleep in…..might be the email I saw this morning , you both know I have been trying since July to get a copy of the 2nd Cafcass report that was never shown to me before we went to Court the first time , well I got a copy last night from an anonymised source, who knows how they got access to this info , if you keep in mind your Solicitor claims she has never seen it , and when I asked the Cafcass worker for a copy while I was at their office in November he told me that he had never seen it either, strange that as this report was the starting point of this mess….. So at long last this can be exposed with the statements filed early in April ,the full police disclosures that was supposed to be Top secret also to show how the allegations changed and got exaggerated and wrongly recorded by the police and Cafcass but yet this is and was used to stop us 3 from having contact and a normal relationship, I can only once again make reference to the monkeys left alone with enough rope , little men…..

I have no clue what you two muppets are doing today but as it is weekend I hope you are having a blast , playing , doing outings , walking B&B and whatever other fun things you two have up your sleeves….as little men should…..

I am struggling to get copies of the Jail book for you both , seems to be out of print , but I will keep looking , even if I can find one copy for you both to share….

Ouma and Oupa says , love you lots!! , I think we are going to braai tonight again , seems the norm now on the weekend , guess that is what Summer in South Africa is all about , not sure all the red meat is doing our health any good but , what to do as they say …lol….

My blackberry seems to have stopped working today for some strange reason, not sure if it is the network from Dubai or South Africa or maybe it’s a sign that I need to move to an IPhone , must say as I told you both before I was dead against touch screen things but the iPad mini with the typing pen has not been so bad , the predictive text thing drives me up the wall as it keeps changing words and makes me look illiterate. I assume I can turn it off but as you both will learn I am a little bit technologically challenged to say the least. It’s been 5 months now already trying to use windows 8 on my work computer and I still can’t find the print icon half of the time , lol don’t giggle you two , it’s serious stuff…..lol

Need to get my stuff packed also tomorrow for next weeks road trip, going to be lots of time in the car, thank goodness for air conditioning , and She’ll Ultra Cities with Wimpy Banana milkshakes… Reminds me of when I was a little boy your age, I must say I also liked to dunk a hotdog in a class of cream soda float….. Lol , makes me wonder what little habits you both have with food stuff, I know you both liked to suck grapes and spit them out when the juice is gone , I also know you both loved a slice of thick white toast with real salted butter…… O and don’t forget spitting juice on me when at the table when we did lip bubbles……, I wonder if you both still do that?……

Sorry pals I seem to have gone over my 600 word daily limit today…. Lots to tell and share with you both I guess….

Please have lots of fun the rest of the weekend……

I will see you both later tonight under our big old green tree in dream land …. Can’t wait for my little men dream cuddles as always…

Miss and love you both big oversize trucks full …….

Love you little men….

Dad xx

Note to the readers of our twin boys blog…..

20140208-092052.jpg

I would like to say a big Thank you to all the people from all over the world that takes the time to read this blog and even more so those who share their stories and comments on what I am saying and how they see things.

The blog is at 5007 hits this morning from 26 Countries, it has 51 comments and thoughts, as I have said before I take all your comments and feedback on board , whether positive or negative as this is a public blog at the end of the day……

I just hope one day my little men will be able to understand the whole story as the blog unfortunately only takes a snapshots of my day to day struggles and of course is written from my perspective ,and don’t think for one minute I do not believe that any Family Law case does not have 3 sides to the story. But as people are scared to show their true personalities while this case is on going they are happy to sit back and be silent as that makes them look like the “victims” the only “victims” in this mess in MY opinion is our little boys as they continue to suffer this abuse daily under the pretext of this being in their best interest…..

Thank you all again for the massive support and heart felt comments and stories of your own struggles…….

On behalf of our little men also , a huge thank you for caring , and as they will do , is blow you a kiss from both hands and wave while they say bye , bye …

Take Care ,

Phill Ferreira
